TERMS AND CONDITIONS

This document constitutes a legally binding agreement between Walseph Shipping (hereinafter referred to as "the Company") and the Customer (the "User" or "Client"). By utilizing our services, you agree to be bound by the terms and conditions set forth below, which are governed by the laws of Jamaica.

1. SERVICE DESCRIPTION

Walseph Shipping provides comprehensive logistics and courier solutions, including but not limited to:

  • Air Freight: Expedited transport for time-sensitive packages.

  • Sea Freight: Economical shipping for larger cargo, including Barrels, Boxes, and Containers.

  • Sourcing: Assistance with procurement from the USA and China.

  • Customs Clearance: Processing of documentation and duties with Jamaica Customs Agency.

  • Last-Mile Delivery: Door-to-door delivery and personal delivery options across Jamaica.

2. CUSTOMER RESPONSIBILITIES

  • Accuracy of Information: Customers must provide accurate descriptions, values, and documentation for all items.

  • Packaging: All items must be securely packaged for international transit. The Company is not liable for damage resulting from insufficient packaging.

  • Prohibited Items: Customers certify that shipments do not contain items on the Standard Customs Blocked List (e.g., explosives, ammunition, illegal drugs, perishable items without permits).

3. COMPANY RESPONSIBILITIES

  • Care Standards: The Company shall exercise reasonable care and skill in handling and transporting goods.

  • Delivery Commitments: The Company aims to make packages available for delivery/pickup within 1–2 business days after the status is updated to "Ready for Pickup" at the local warehouse.

4. PRICING AND PAYMENT

  • Rates: Freight charges are calculated based on weight (per lb) or dimensions, as per current market rates.

  • Processing Fees: A standard fee of $200 JMD applies per package.

  • Island-wide Delivery: Door-to-door delivery is available across Jamaica; costs vary based on distance and location.

  • Payment Terms: All freight, duties, and processing fees must be paid in full prior to or at the time of delivery/collection.

5. LIABILITY AND INSURANCE

  • Liability Limits: The Company’s liability is limited to the declared value of the goods or a maximum cap set by industry standards, whichever is lower.

  • Claims: Any claims for loss or damage must be submitted in writing within 48 hours of delivery or collection, accompanied by photographic evidence.

6. PROHIBITED ITEMS

The Company strictly adheres to Jamaican law and international shipping regulations. We will not transport:

  • Hazardous materials or dangerous goods.

  • Currency, jewelry, or high-value bullion.

  • Any items explicitly restricted by the Jamaica Customs Agency.

7. DELIVERY TERMS AND STORAGE

  • Operating Hours:

    • Monday – Friday: 8:00 AM – 5:00 PM

    • Saturday: 9:00 AM – 3:00 PM

    • Sundays & Public Holidays: Closed

  • Storage Fees: Packages held beyond 15 days at a collection point will incur a storage fee of $100 JMD per day.

  • Failed Delivery: If a door-to-door delivery fails due to the customer’s absence or incorrect address, additional redelivery fees may apply.

8. FORCE MAJEURE

The Company is not liable for delays or failures in performance caused by events beyond its control, including but not limited to:

  • Natural disasters (hurricanes, earthquakes).

  • Customs inspections or government-mandated delays.

  • Global supply chain disruptions or carrier cancellations.

9. DISPUTE RESOLUTION

  • Complaints: Customers should first attempt to resolve issues by contacting [email protected].

  • Governing Law: These terms are governed by and construed in accordance with the Laws of Jamaica. Any unresolved disputes shall be subject to the exclusive jurisdiction of the Jamaican courts.

10. PRIVACY AND DATA PROTECTION

The Company collects and stores customer data (name, TRN, contact details) solely for the purpose of service fulfillment and legal compliance. We do not sell or share personal data with third parties for marketing purposes.

11. MODIFICATION TERMS

Walseph Shipping reserves the right to update these Terms and Conditions at any time. Customers will be notified of significant changes via the website or email. Continued use of the service constitutes acceptance of the updated terms.

12. REFUND POLICY

  • Service Fees: Freight and processing fees are generally non-refundable once the service has been performed.

  • Refund Requests: Requests for refunds must be submitted in writing and will be evaluated on a case-by-case basis (e.g., double billing or service failure attributable solely to the Company).
